2. DEFINITIONS

holiday) on which banks are generally open for business in England & Wales.

3. SCOPE OF THESE TERMS
- These Terms apply to all sales of Goods made by CULTUR to Customers through the Website.
- These Terms do not govern ticket sales, live events, services, or any other business activities conducted under the CULTUR brand outside of shop.cultur.fm, each of which may be subject to separate terms and conditions.
- In the event of any conflict between these Terms and information appearing elsewhere on the Website, these Terms shall prevail.
- CULTUR may amend these Terms from time to time. The Terms applicable to your Order are those in force at the time you place the Order.
4. AGE AND CAPACITY
- By placing an Order, you warrant that:
- you are at least 18 years of age; and
- you have legal capacity to enter into a binding contract.
- CULTUR reserves the right to refuse Orders where we reasonably believe the Customer does not meet these requirements.

6. COMMUNICATIONS & NOTICES

- Notices from CULTUR will be delivered to the email address you provide at checkout or in your account.
- Notices are deemed received:
- at the time of transmission if sent during Business Hours; or
- at 09:00 on the next Business Day if sent outside Business Hours.
7. ENTIRE AGREEMENT
- These Terms, together with your Order and any dispatch confirmation email, constitute the entire agreement between CULTUR and you in relation to the sale of Goods.

8. ORDERING PROCESS

- selected products, sizes and quantities;
- payment details.
- CULTUR shall not be liable for any delay, loss or additional costs arising from incorrect or incomplete information provided by you.
9. ORDER ACCEPTANCE & CONTRACT FORMATION
- After placing an Order, you will receive an email acknowledging receipt (“Order Acknowledgement”). This does not constitute acceptance of your Order.
- A Contract between you and CULTUR is formed only when we send a further email confirming that your Order has been dispatched (“Dispatch Confirmation”).
- CULTUR reserves the right, at our sole discretion, to refuse or cancel any Order before dispatch, including but not limited to cases where:
- payment authorisation cannot be obtained;
- we suspect fraudulent activity or misuse;
- the Goods are out of stock or no longer available;
- a pricing or product description error is discovered;
- shipping to your location is not supported or is disproportionately costly.
- If your Order is refused or cancelled by CULTUR before dispatch, any payment already taken will be refunded.
10. PRE-ORDERS
- Some Goods may be designated as Pre-Order, Made-to-Order or similar. By placing a Pre-Order you acknowledge that:
- Goods may not be in stock at the time of purchase;
- Dispatch dates are estimates and may be subject to delay;
- The final product may differ slightly from any samples or images due to manufacturing processes.
- Pre-Orders are strictly non-cancellable once placed, except where required by law.
- Delays in the manufacture or delivery of Pre-Order Goods, including delays caused by suppliers, logistics, or Force Majeure Events, do not entitle you to compensation, damages or price reductions.
11. PRICING
- Prices of Goods are as displayed on the Website at the time of your Order.
- Prices are shown in GBP (£) and include VAT where applicable, but exclude shipping costs, customs duties and other local taxes unless otherwise stated.
- Shipping costs will be displayed separately at checkout.
- CULTUR reserves the right to change prices at any time. Changes will not affect Orders for which a Dispatch Confirmation has already been issued.
- In the event of a pricing error that is obvious and unmistakeable and could reasonably have been recognised as a mispricing, CULTUR is under no obligation to supply the Goods at the incorrect price. We may cancel the Order and refund any payment made.

- have no cash value and cannot be exchanged for cash.
- Gift cards (if offered):
- are non-refundable and cannot be exchanged for cash;
- are typically valid for 12 months from date of issue unless otherwise stated;
- become your responsibility once delivered; CULTUR is not liable for loss, theft or unauthorised use.
- CULTUR reserves the right to:
- cancel Orders where discount codes or gift cards have been obtained fraudulently or used contrary to their terms;

14. FRAUD PREVENTION
- CULTUR uses fraud detection and security systems to protect against unauthorised or unlawful transactions.

- refuse refunds or service to individuals involved in chargeback abuse, return fraud or other deceptive behaviour;

- In the event of a chargeback, CULTUR reserves the right to provide evidence of delivery and communications to dispute the claim.
15. CUSTOMER ORDER CANCELLATION
- You may request cancellation of an Order before dispatch. CULTUR cannot guarantee that cancellation will be possible if the Order has already entered the dispatch process.
- Pre-Orders cannot be cancelled once placed, save where you are legally entitled to do so.
16. CANCELLATION BY CULTUR
- CULTUR may cancel an Order prior to dispatch where:
- payment authorisation is unsuccessful;
- suspected fraud or abusive activity exists;
- Goods are unavailable or discontinued;
- a pricing or description error is discovered;
- it is not reasonably possible to deliver to your location.

17. SHIPPING DESTINATIONS
- CULTUR currently ships to:
- the United Kingdom;
- the majority of European Union member states;
- the United States of America.
- Shipping availability may change at any time.
18. DELIVERY TIMEFRAMES
- Indicative delivery times are: UK: 2–4 Business Days from dispatch; International (EU & USA): 5–14 Business Days from dispatch.
- Delivery estimates are not guaranteed and do not form part of the Contract.
- CULTUR shall not be liable for delays caused by:
- courier or postal service failures;
- customs processing;
- peak demand periods;
- Force Majeure Events.
19. DISPATCH & MULTI-PARCEL SHIPMENTS
- Goods will be prepared for dispatch once payment is received and stock is confirmed.
- CULTUR may, at its discretion, dispatch Goods in multiple parcels without additional charge.
- Dispatch notifications will be sent via email.
20. DELIVERY ADDRESS & ACCESS
- You are responsible for providing a complete and accurate delivery address.
- CULTUR is not responsible for:
- failed deliveries due to incorrect or incomplete address details;
- failure to collect parcels from a depot or pickup location;
- refusals by building management, concierge or similar.
- If a parcel is returned to CULTUR due to Customer error or inaction, CULTUR may:
- refund the price of the Goods only (excluding shipping); or
- offer re-delivery at additional cost.
21. SAFE PLACE, NEIGHBOUR & LOCKER DELIVERIES
- If you instruct the courier to leave a parcel in a safe place, with a neighbour, at a parcel locker, or with reception/concierge, risk in the Goods passes to you once the courier confirms delivery to that location.
- CULTUR is not liable for theft, loss or damage occurring after such delivery.
22. DELIVERY CONFIRMATION & DISPUTES
- Courier tracking stating “Delivered” shall be deemed sufficient evidence of delivery.
- If you dispute delivery, CULTUR may:
- request investigation by the courier;
- obtain GPS, driver notes or photographic evidence;
- withhold any refund or replacement until investigation is complete.
- If courier evidence supports that delivery occurred, CULTUR is under no obligation to provide a refund or replacement.
23. LOST, DAMAGED OR STOLEN PARCELS
- A parcel will be considered lost only once the courier confirms it as such or after completion of their investigation.
- CULTUR is not responsible for:
- stolen parcels after confirmed delivery;
- parcels lost due to incorrect addresses provided by you;
- loss arising from your failure to collect the parcel.
- Damage in transit must be reported to CULTUR within 48 hours of delivery, supported by clear photographs.
24. CUSTOMS, DUTIES & TAXES (INTERNATIONAL ORDERS)
- International Orders may be subject to import duties, taxes and customs charges imposed by the destination country.
- These charges are your sole responsibility unless explicitly stated otherwise on the Website.
- Refusal to pay customs charges may result in the parcel being returned, destroyed or seized. CULTUR is not liable for such outcomes and may refund only the cost of Goods at its discretion.
25. RISK & TITLE
- Risk in the Goods passes to you when:
- the Goods are delivered to your specified address; or
- the Goods are delivered to a neighbour, locker or safe place in accordance with your instructions.
- Title to the Goods passes only when CULTUR has received cleared payment in full.
26. FORCE MAJEURE
- CULTUR shall not be liable for any failure or delay in performance of its obligations under a Contract where such failure is caused by a Force Majeure Event.
- During a Force Majeure Event, CULTUR’s obligations are suspended for the duration of the event.
- If a Force Majeure Event continues for more than 60 days, CULTUR may cancel affected Orders and refund any amounts paid for undelivered Goods. RETURNS, REFUNDS & FAULTY GOODS
27. GENERAL RETURNS POLICY (UNWANTED GOODS)
- CULTUR offers a 14-day return period for unwanted or change-of-mind returns.
- The 14-day period begins on the day you receive the Goods.
- To initiate a return, you must contact shop@cultur.fm within 14 days of delivery and await instructions.
- You are responsible for the cost of returning unwanted Goods.
- Goods returned without prior contact or outside the permitted period may be refused.
28. NON-RETURNABLE GOODS
- The following items are non-returnable except where required by law:
- sale items;
- limited drops or exclusive releases;
- personalised, customised or made-to-order Goods;
- underwear, undergarments or intimate products;
- Goods marked “Final Sale” or “Non-Returnable”;
- gift cards;
- digital products once accessed or downloaded;
- Goods returned in an unsanitary or excessively worn condition.
29. CONDITION OF RETURNED GOODS
- To be eligible for a refund, returned Goods must be:
- unworn and unwashed;
- undamaged and unaltered;
- free from odours (including perfume, smoke or deodorant);
- free from stains, marks, makeup or pet hair;
- returned with all original tags, labels and hygiene seals intact;
- returned with original packaging (garment bags, boxes, inserts) and any accessories or extras supplied.
- CULTUR reserves the right to refuse or reduce refunds where Goods show signs of wear, use, damage, washing, alteration or poor condition.
30. RETURN SHIPPING & RISK
- You are responsible for:
- arranging return shipment;
- using a tracked and, where appropriate, insured service;
- ensuring suitable packaging to prevent damage.
- You bear all risk of loss or damage to the Goods until they are received by CULTUR.
31. RETURN PACKAGING
- Goods must be returned in their original packaging where reasonably possible.
- Failure to return original packaging may result in a reduction of your refund to reflect diminished value.
32. DIMINISHED VALUE
- CULTUR may reduce the amount of any refund to reflect loss in value resulting from:
- handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods;
- damage to packaging;
- missing components or accessories;
- other signs of wear or misuse.
33. REFUND PROCESSING
- Refunds, where approved, will be processed within a reasonable time and, in any event, within 14 Business Days of receiving returned Goods.

- wardrobing (wearing items before returning them);
- returning counterfeit, damaged or different items in place of those purchased;
- repeated false claims of non-delivery or non-receipt;
- abusing returns to obtain free short-term use of Goods.
- CULTUR may, at its sole discretion:
- refuse refunds;
- block future purchases;
- report misconduct to relevant authorities or payment processors;
- take legal action.
36. RESTOCKING FEES
- CULTUR reserves the right to apply a restocking fee of up to 20% of the product value where:
- Goods are returned without respecting the stated conditions;
- packaging is significantly damaged;
- the Goods require additional processing before resale.
37. FAULTY OR INCORRECT GOODS
- If Goods are faulty, damaged or not as described, you must notify CULTUR at shop@cultur.fm within 48 hours of delivery.
- You must provide clear photographic or video evidence of:
- the defect or damage; and
- the product and packaging.
- CULTUR will assess your claim and, if the Goods are confirmed as faulty or incorrect, may:
- offer a replacement;
- offer a repair; or
- provide a refund where a replacement is not available or a repair is not appropriate.
- Damage caused by misuse, improper care, accident or normal wear and tear is not considered a fault.
38. RETURNING FAULTY GOODS
- Do not return any faulty Goods until instructed by CULTUR.
- CULTUR may, at its discretion, cover return shipping costs for verified faults or provide an alternative remedy without requiring return.
- If you return Goods claimed to be faulty and CULTUR determines that they are not faulty under these Terms, the Goods may be returned to you at your cost.
39. DIGITAL GOODS
- Where CULTUR offers digital goods (such as downloads, codes or access passes), these are non-refundable once accessed or downloaded.

- CULTUR endeavours to ensure that product descriptions, photographs and other information are accurate.
- Minor differences in colour, shading, texture or placement of prints may occur due to fabric variation, manufacturing tolerances or digital display differences. Such variations do not constitute defects.
41. SIZING & MANUFACTURING TOLERANCES
- Size charts and fit guides are approximate and for guidance only.
- Manufacturing tolerances of ±2cm in garment measurements are considered acceptable and do not constitute a defect.
- Differences in fit due to individual body shape or preference are not faults.
42. CARE INSTRUCTIONS & MISUSE
- Care labels and instructions must be followed. CULTUR is not liable for:
- shrinkage, fading or distortion caused by incorrect washing or drying;
- damage caused by bleach or harsh detergents;
- racking or peeling of prints caused by ironing or tumble drying contrary to care instructions.
- Damage arising from misuse or failure to follow care instructions is not a manufacturing defect.
43. NATURAL WEAR & TEAR
- Natural wear and tear of Goods resulting from normal use (including pilling, colour fading, small thread pulls and moderate print wear) does not constitute a defect and is not covered by any warranty or returns policy beyond statutory rights.
44. PRODUCT AVAILABILITY
- All Goods are offered subject to availability.
- CULTUR may change, discontinue or remove products or collections at any time without notice.
- In the event that an item becomes unavailable after you place an Order, CULTUR may cancel the Order and refund any payment made.
45. RESALE & UNAUTHORISED COMMERCIAL USE
- Goods purchased from the Website are for personal use only and are not authorised for commercial resale or distribution without prior written approval from CULTUR.
- You must not:
- purchase Goods for the purpose of resale;
- hold yourself out as an authorised reseller or agent of CULTUR;

- If you tag CULTUR, use CULTUR-related hashtags, or otherwise submit or share content featuring CULTUR Goods (including photos, videos, reviews or comments), you grant CULTUR a worldwide, royalty-free, perpetual and irrevocable licence to:
- use, reproduce, distribute, modify, adapt and display such content;
- feature such content on the Website, social media platforms and marketing materials.
- You warrant that any such content is your original work and does not infringe third-party rights.
48. ACCEPTABLE USE OF THE WEBSITE
- You must not:

60. JURISDICTION
- The courts of England & Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or any Contract.

- CULTUR will endeavour to respond within a reasonable timeframe.
62. NOTICES
- Formal notices to CULTUR should be sent via email to shop@cultur.fm.
- Notices to you will be sent to the email address registered with your Order or account.
63. CHANGES TO TERMS
- CULTUR may revise these Terms at any time.
- The revised Terms will apply to any Orders placed after the date of publication on the Website.
64. LANGUAGE
- These Terms may be made available in other languages, but the English version shall prevail in the event of any inconsistency.
65. PRIVACY & COOKIES

66. SURVIVAL
